| JCC Weiss (Fort Myers) (Brian Ricotta) (11-12-24) – Granted E/C’s Motion to Enforce Settlement. The E/C filed a Motion to Enforce Settlement after the parties agreed to a lump sum settlement of $13,500.00, inclusive of attorney’s fees and costs. At the time of the hearing, the claimant’s attorney had withdrawn and filed a lien, but was present at the hearing. The claimant acknowledged the monetary terms of settlement but objected to specific conditions proposed in the settlement documents. The JCC concluded that the claimant had agreed to the monetary value of the settlement but did not have jurisdiction to order the claimant to sign the settlement documents at issue. Accordingly, the JCC granted the Motion and ordered the E/C to pay the claimant’s net of $10,100.00 and ordered the claimant’s prior counsel to file a Verified Petition to resolve the past attorney fee lien.
