Washington v. brakben, Inc. / FedEx Ground Packageg System Inc. / Protective Insurance
Scott B. Miller
JCC Hedler (West Palm Beach) – (2-25-19) – Granted Claimant’s Motion for Advance – The Claimant alleged an injury on December 5, 2018. The Claimant further argued that he reported the injury to the employer, who failed to report the injury to the carrier. At the time of the injury, the Claimant testified that he earned $600 per week, and would have earned $800 per week after completion of his training program. The Claimant was out of work from the date of the injury through February 22, 2019, when he started driving for Lyft. The Claimant testified to $1,437 in expenses per month. The JCC found that the Claimant was a proper claimant for the purposes of the present motion for advance. The JCC further found that the Claimant provided economic justification for the awarding of a $2,000 advance, which was the amount granted.
